New York is the biggest sports betting market in America. It took $26.3 billion in mobile wagers in 2025, according to New York State Gaming Commission (NYSGC) data, and it taxes operators at 51%, one of the highest rates in the country.
That combination shapes everything you see on this page: 8 licensed apps, smaller welcome offers than in New Jersey, and a regulator that polices bonus wording harder than anyone else. Here’s how the NY sportsbooks stack up, and how we decide.

Mobile sports betting, horse racing apps, daily fantasy sports and lottery couriers are legal and licensed in New York. So are the state’s commercial, tribal and racino casinos.
Online casinos and online poker are not. Senate bill S2614, which would legalize both, stalled in committee again in 2026 after Sen. Joseph Addabbo said Gov. Kathy Hochul would probably not sign it.
Sweepstakes casinos are now explicitly illegal. Hochul signed the ban on Dec. 5, 2025, with fines of $10,000 to $100,000 per violation for operators, payment processors and media affiliates. Prediction markets such as Kalshi and Polymarket are in court with the state, which calls their sports contracts illegal gambling.
Horse racing is the oldest legal option and the easiest to bet online. Licensed advance-deposit wagering apps took $52.0 million from New Yorkers in September 2026, per NYSGC’s market origin report, led by TVG at $28.8 million. The rebuilt Belmont Park reopened on Sept. 18, 2026, and the Belmont Stakes returns there in 2027.
Daily fantasy is legal through 13 NYSGC-permitted operators, including DraftKings, FanDuel, Underdog and PrizePicks. Pick’em contests that mimic prop bets against the house are not allowed.

New York’s mobile market keeps growing even at a 51% tax rate. According to the NYSGC statewide monthly report:

The 2025 handle was up 15.8% on 2024 and revenue rose 25%, according to CasinoBeats. FanDuel and DraftKings took 76% of 2025 revenue between them.
The tax money goes to education aid. The state also sets aside $5 million a year for youth sports and $6 million a year for problem gambling programs, per the NYSGC sports wagering page.
The two giants still dominate. In August 2026, DraftKings ($614.0 million) and FanDuel ($599.6 million) together took 70% of NY handle. Fanatics was a distant third at $213.2 million, and the bottom three apps combined took less than 5%.
Football season drives the calendar. The first four weeks of September 2026 brought in about $2.26 billion in handle, up from $1.73 billion for all of August.
