New York online casinos: still not legal in 2026, and what you can play instead
No licensed real-money online casino operates in New York. The Addabbo bill died in committee for a fifth straight year in 2026, even as Queens got its first full casino floor.
Are online casinos legal in NY? Not yet — here’s where the bill stands
Real-money online casinos are not legal in New York, and no site holds a New York license to offer online slots, blackjack or roulette. Any app or website taking real-money casino bets from you inside the state is operating outside New York law.
That’s the short answer. The longer one is more useful: what Albany has tried, why it keeps failing, and what you can legally play while you wait.
| Vertical | Status in NY (Oct 2026) |
|---|---|
| Online casino (slots, tables, live dealer) | Not legal |
| Online poker | Not legal |
| Sweepstakes casinos | Banned since Dec 5, 2025 |
| Mobile sports betting | Legal since Jan 8, 2022 |
| Retail casinos and racinos | Legal |

S2614: the Addabbo bill that would legalize iGaming in NY
Sen. Joseph Addabbo Jr. (D-Queens), chair of the Senate Racing, Gaming and Wagering Committee, has filed an online casino bill every year since 2022: S8412 in 2022, S4856 in 2023 and S8185 in 2024. None reached a floor vote.
The current version, S2614, was introduced on Jan. 21, 2025. Its Assembly companion is A6027, sponsored by Assemblymember Carrie Woerner. Here’s what it would do:
- Legalize online slots, table games, live dealer games and online poker for players 21 and over who are physically in New York.
- License commercial casinos, VLT facilities, tribes with compacts and the existing mobile sportsbooks.
- Charge a one-time $2 million license fee for operators and $10 million for independent platform providers, with licenses lasting up to 10 years.
- Tax online casino revenue at 30.5%, well below the 51% New York takes from mobile sports betting.
- Set aside at least $25 million a year for a casino-worker fund and $11 million a year for problem gambling programs.
- Authorize online lottery sales.
Where S2614 stands in 2026
The bill was re-referred to committee on Jan. 7, 2026, and never moved again. On May 24, 2026, Addabbo told reporters he wouldn’t push it: “We could pass it in the Senate, we could pass it in the Assembly, and then the governor would probably not sign it.”
The session ended June 4. Because 2026 was the second year of the 2025–26 legislative session, S2614 dies with it. Any 2027 attempt starts from a new bill number.
Why internet casinos stalled: unions, retail casinos and the governor
Three forces keep iGaming off the floor in Albany.
The casino workers’ union. The New York Hotel and Gaming Trades Council has led the opposition. Its political director, Bhav Tibrewal, has called iGaming “not a job creator” and dismissed the bill’s worker fund as “bells and whistles on a job killer,” according to Global Gaming Business.
The new retail casinos. New York has just licensed three NYC-area casinos, with license fees totaling about $1.5 billion and multibillion-dollar build-outs promised. Lawmakers are wary of approving a product that could pull customers off those floors before two of them have even opened.
The governor. Gov. Kathy Hochul has not endorsed online casinos. After Addabbo shelved the bill, a spokesperson said only that she “will review any legislation that passes” both houses. The unresolved Seneca Nation compact, still in dispute in October 2026, adds another complication for any statewide online product.

The state’s Gaming Facility Location Board picked three projects on Dec. 1, 2025, and the NYSGC approved the licenses on Dec. 15, 2025.

Tribal casinos and VLT racinos
The Seneca Nation, Oneida Indian Nation and St. Regis Mohawk Tribe run Class III casinos under state compacts, including Turning Stone, Seneca Niagara and Akwesasne Mohawk. Turning Stone admits gamblers from age 18.

Real-money casino sites near NY: 7 states where they’re legal
Real-money online casinos are live in seven states, and four of them are within driving distance of New York City. You don’t need to live there. You only need to be physically inside the state when you play, verified by geolocation, and be 21 or over.
| State | Online casinos live since | Note for New Yorkers |
|---|---|---|
| New Jersey | Nov. 2013 | Largest market; a train ride from Manhattan |
| Pennsylvania | July 2019 | Borders NY’s Southern Tier |
| Connecticut | Oct. 2021 | Tribal-partnered apps only |
| Delaware | Oct. 2013 | Smallest market |
| Michigan | Jan. 2021 | Large market, but a long drive from NY |
| West Virginia | July 2020 | Several national brands live |
| Rhode Island | Mar. 2024 | A single app, run with the state lottery |
Maine has passed a tribal online casino law but had no platform live as of August 2026.
The apps stop working the moment you cross back into New York. New York residents also owe state income tax on gambling winnings, wherever they win.
“Online casino NY real money no deposit”: what those offers really are
A search for “online casino ny real money no deposit” turns up offers that look like they’re for New Yorkers. They aren’t legal ones. A real-money no-deposit casino bonus aimed at NY players is coming from either an offshore site or a sweepstakes brand, and both are now off-limits in the state.
No-deposit casino bonuses do exist in NJ, PA and the other regulated states. We explain how they work, and where they’re legal, in our no-deposit casino bonus guide.
Sweepstakes casinos: why the state banned them
Sweepstakes casinos used a two-currency model to sidestep gambling law: you bought Gold Coins and got “bonus” Sweeps Coins you could redeem for cash. New York shut that door.
Gov. Hochul signed S5935A on Dec. 5, 2025, and it took effect immediately. It bans online sweepstakes games with cash prizes and fines operators, suppliers, payment processors and media affiliates $10,000 to $100,000 per violation. Six months earlier, Attorney General Letitia James had already pushed 26 platforms to stop selling sweeps coins in New York. The full story is in our NY sweepstakes ban guide.
How to spot an offshore gambling site
Offshore casinos are the sites still happy to take your money in New York. Here’s how to recognize one:
- No New York license. New York has issued no online casino licenses, so any site claiming one is lying. The NYSGC publishes its licensed operators on gaming.ny.gov.
- No location check. Legal apps in NJ or PA block you outside their state. If a casino lets you play from Queens, it isn’t regulated anywhere in the U.S.
- Crypto-first banking. Bitcoin deposits, no PayPal and vague withdrawal times are typical.
- A license from somewhere else. Curaçao or another offshore regulator offers you no protection in a U.S. dispute.
- No self-exclusion link. Regulated U.S. operators connect to state exclusion programs. Offshore sites don’t.
If an offshore site freezes your balance, no New York agency can make it pay.
When could NY casino apps arrive?
The earliest chance is the 2027 legislative session, which opens in January. Addabbo is widely expected to refile, and analysts cited by PlayUSA estimate a legal NY market could produce about $2.5 billion a year in gross gaming revenue.
Three things would have to change:
- The governor would have to commit to signing. The November 2026 election decides who that is.
- Union opposition would need to soften, likely through bigger worker protections.
- Both houses would have to pass the bill before the session ends in June.
Even then, regulators would need to write rules and license operators before the first app goes live, a process that has taken months in other states.
